Senate Majority Leader Mitch McConnell stated that nationwide abortion legislation is "possible" if the Supreme Court overturns Roe v. Wade.
The Kentucky Republican told USA Today, "If the leaked opinion became the final opinion, state and federal legislative bodies could certainly legislate in that area."
"At that point, if this were the ultimate judgment, it should have been handled one way or another through the legislative process. Therefore, anything is possible," McConnell stated.
Since the release of a draft majority opinion prepared by Justice Samuel Alito last week, which indicates the court is poised to overturn the 1973 landmark decision in June, the argument over abortion rights has taken on a new significance.
In his opinion, Alito maintained that it is up to the states to determine whether or not to restrict abortion rights.
Some Republicans have been angrier about the leaking of the paper than the decision itself, fearing a potential voter backlash during the midterm elections of November 2022.
However, the minority leader of the Senate stated that the Republicans' stance on the subject would become evident after the Supreme Court acts officially.
Regarding the abortion issue, I believe it is reasonably evident where Senate Republicans stand. When the court renders a final verdict, I anticipate that everyone will be more decisive," he remarked. "However, I don't believe it's much of a secret where Republican senators stand on this issue."
Tuesday, Senate Majority Leader Chuck Schumer, who with House Speaker Nancy Pelosi branded the judgment an "abomination," will schedule a vote to establish Roe v. Wade as federal law.
However, it is unlikely to pass because the Democrats lack the sixty votes required to approve legislation in the Senate.
