In an attempt to overturn the CDC's decision, landlord group asked a judge in Washington to overturn the ban on the eviction.

The US Centers for Diseases Control and Prevention, CDC, extended the ban on eviction as it was going to expire on the first of August. If not extended, millions of Americans would go homeless.

However, the Supreme Court had already urged Biden Adminstration to not extend the ban and had said that the Biden Administration can no longer do so.

Landlord groups said that the act is "un lawful" and "politically motivated.

In June, a divided Supreme Court agreed to let the CDC moratorium remain in effect after the CDC announced it would allow the ban to expire on July 31.

The White House had repeatedly said previously before Tuesday's order it did not believe it had legal authority to extend eviction protections.
