Prince Andrew is again attempting to have the civil action launched against him dismissed by Virginia Roberts Giuffre, who alleges she was coerced into having sex with the prince.
Andrew, pictured hours earlier horseback riding near his home in Windsor Great Park, also urged the presiding court to seal parts of his responses to Giuffre's charges in a petition Monday evening.
Andrew controversially requested that judge Lewis Kaplan dismiss Giuffre's complaint, arguing that the New York Child Victims Act, the legislation under which she is suing, is flawed because it classifies those under the age of eighteen as minors, while the legal age of consent in New York is seventeen, according to the London Times. Giuffre claims she was seventeen years old when she was compelled to have sex with the prince several times and in various locations over the world in 2001.
A photograph showing Andrew wrapping his arm around an adolescent Giuffre's naked midriff has circulated in the media for numerous years, although Andrew maintains that he never met Giuffre. The shot, which has Ghislaine Maxwell in the background, was taken in her London residence by Jeffrey Epstein, who committed suicide in a jail cell in 2019.
Andrew's associates have previously created stories in the news claiming he feels the image is a forgery, a claim that has astonished his adversaries.
According to the London Times, Andrew's legal team argues in a new filing that the Child Victims Act is "not a reasonable mechanism for addressing the injustice of child sexual abuse in New York" because it classifies under-18s as minors "despite the fact that the legal age of consent in New York is seventeen."
Andrew argues that "the issue of consent remains unresolved in the case of those, like Giuffre, who were between the ages of seventeen and eighteen."
According to the Times, Andrew's legal team, led by Andrew Brettler, acknowledges in court documents that it is possible to establish lack of consent by demonstrating an "implied threat" was made, but that it would be difficult to prove "as memories fade, false memories are created, and witnesses die or otherwise become unavailable."
According to the petition, the only witnesses to Giuffre's claimed unconsented sex actions with Prince Andrew are Epstein (dead), Maxwell (incarcerated), Prince Andrew (the accused), and Giuffre herself.
Additionally, the Times writes that Andrew believes he should be shielded from legal action by Giuffre under the terms of a 2009 deal she reached with Epstein.
According to the Times, Kaplan "agreed to a delay until January 14 last night."
