The US Tuesday, voted to move forward with the impeachment trial after hearing the arguments from Trump's lawyers who said impeachment is unconstitutional.
Defense lawyers had argued that Mr. Trump can no longer be impeached as he is no longer the president. However, Senate rejected that argument, and 6 Republicans joined the 50 democrats to move forward with the impeachment trial.
Impeachment managers put forward the argument if one can not be impeached after leaving the office, it will imply that you can do anything - then resign without any future consequences.
They also put forward the precedent when the Secretary of War William Worth Belknap was impeached after leaving the office.
Lead House Prosecutor John Raskin said nothing is impeachable if the incitement of insurrection at the US Capitol is not. He said, "Our case is based on cold, hard facts. It´s all about the facts. These are the things and events that happen when a sacred landslide election victory is so unceremoniously & viciously stripped away. If that’s not an impeachable offense, then there’s no such thing."
The impeachment proceedings will resume at Wednesday noon, Eastern Standard time.
